Digital Millennium Copyright Act (DMCA) Policy

Americanca LLC, doing business as Desiree.io (“Desiree”, “we”, “our”, or “us”) respects the intellectual property rights of creators and copyright holders and complies fully with the provisions of the Digital Millennium Copyright Act (DMCA). This DMCA Policy explains how to submit copyright infringement claims and counter-notifications regarding content hosted on https://dev.desiree.io and affiliated websites, services, or platforms (collectively, the “Services”).

1. Reporting Copyright Infringement

If you believe that content available through our Services infringes upon your copyright, you or your authorized agent may submit a DMCA takedown notice by providing the following written information:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  • A description of the copyrighted work claimed to have been infringed;
  • The location (URL) of the infringing material on our Services;
  • Your contact information (including full name, mailing address, telephone number, and email address);
  • A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law;
  • A statement, made under penalty of perjury, that the information provided in the notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

2. Our Response to DMCA Notices

Upon receipt of a valid DMCA takedown notice:

  • We will promptly acknowledge the notice and review its completeness;
  • If valid, we will disable access to or remove the allegedly infringing material within 1–3 business days;
  • We will notify the user responsible for the content and provide them with a copy of the notice, along with instructions for submitting a counter-notification if applicable.

3. Submitting a Counter-Notification

If you believe a DMCA notice has been wrongly filed against you, you may submit a counter-notification that must include:

  • Your name, address, phone number, and email address;
  • A description of the material that has been removed or disabled and the URL where it previously appeared;
  • A statement under penalty of perjury that you believe the material was removed or disabled as a result of mistake or misidentification;
  • A statement that you consent to the jurisdiction of the federal district court for your judicial district (or if outside the U.S., the U.S. District Court for the Northern District of California) and that you will accept service of process from the person who provided the original DMCA notice or their agent;
  • Your physical or electronic signature.

After receiving a valid counter-notification, we will:

  • Notify the original complainant;
  • Restore the removed content within 10–14 business days unless we receive notice that a court action has been filed to restrain the user from engaging in infringing activity.

4. Repeat Infringers and Termination Policy

Desiree.io reserves the right to suspend or terminate accounts of users who are found to be repeat infringers under the DMCA or who repeatedly submit false DMCA notices or counter-notices. We may also take further legal or technical action when appropriate.
