At Americanca LLC (DBA: Desiree.io), we are committed to ensuring that our platform and services are used responsibly and strictly by individuals who meet the legal age requirement of 18 years or older.

We also take a firm stand to ensure that AI-generated content on Desiree.io does not resemble, reference, or exploit minors in any way. To that end, we have implemented strict moderation systems and maintain compliance with applicable laws and our internal Terms of Service, Privacy Policy, and Community Standards.

1. Website Access and Age Verification

We have enforced measures to prevent access by users under 18, including:

• Age gate upon entry requiring users to affirm they are 18+.
• Clear warning banner that states “You must be 18 years or older to enter.”
• Notification that providing false information about age violates our Terms of Service.
• Systems for potential future age verification, as required by California law or industry compliance standards.

2. Responsibility for AI Content

As a user, you are solely responsible for:

• Inputs submitted to our AI chat companions.
• Outputs generated by the AI.

AI responses are driven by your prompts and choices. Desiree.io does not create or control these prompts and is not responsible for misuse. You agree not to use the service to generate any content that:

• Depicts minors
• Imitates, simulates, or references children in suggestive or harmful ways
• Violates U.S. federal or state laws regarding child safety or exploitation

Such use will result in immediate account termination and may be reported to authorities.

3. Moderation, Monitoring, and Enforcement

We use automated LLM-based content filters and moderators to scan for violations of our policies, including:

• Inappropriate or unsafe content
• Terms that suggest underage roleplay or likeness
• Any prompts suggesting child exploitation

Flagged content may be reviewed manually. Based on the severity, we may:

• Issue a warning
• Suspend or terminate your account
• Forward evidence to relevant law enforcement

Our moderation exists to protect users and uphold the law.

4. Zero-Tolerance Policy on Child Exploitation (CSAM)

We operate under a strict zero-tolerance policy for any content remotely involving Child Sexual Abuse Material (CSAM) or depictions of minors.

We:

• Immediately report confirmed CSAM to NCMEC (National Center for Missing and Exploited Children)
• Cooperate with local, state, and federal law enforcement
  
• Use real-time filtering to prevent content creation that may violate these standards

6. Account Termination

Users found in violation may also be banned permanently, even if age misrepresentation was unintentional.
